A University of California student has been cleared of rape after security footage from a college dormitory and nightclub emerged.
On April 1, Arman Premjee who is 20-years old was accused of raping a 19-year old girl in her dorm room. The two met at Banditos Taco & Tequila in Los Angeles. However, footage shows that this is not the case.
The video shows the girl kissing Premjee and making sexual gestures towards him, before leading him out of the nightclub.
Premjee denied the accusations of raping by use of drugs and sexual penetration by a foreign object, and spoke to CBS Los Angeles about the incident.
“She put her arms around my neck, she started kissing me,” he said.
Prosecutors said that the girl was too drunk to give Premjee her consent. However, video from the dormitory shows the girl signing him in, and video outside the nightclub shows her poking a finger through a circle made with her hand – behind his back to her friend.
The woman said that she didn’t remember anything from the night, but Premjee disagreed.
“She knew what she was doing. She was able to stand on her own two feet. She led the way.”
A Los Angeles Superior Court judge dismissed the case after seeing the video on Tuesday.
“I believe there was consent. There is a very strong indication that the alleged victim in this case was the initiator,” they said.
